Welcome to WriteInFrench.com and WriteInSpanish.com (collectively, the "Service"). These Terms of Service ("Terms") govern your access to and use of our online language learning platform. By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

WriteInFrench.com and WriteInSpanish.com provide online language learning tools and resources. The Service offers various subscription plans that provide access to learning materials, exercises, and interactive features designed to help users learn French and Spanish.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

4. Subscription and Payments

4.1 Free Trial

We offer a 7-day free trial for new subscribers. You will not be charged during the trial period. If you do not cancel before the trial period ends, your subscription will automatically begin, and you will be charged the applicable subscription fee.

4.2 Subscription Fees

Subscription fees are charged on a recurring basis according to your selected plan (monthly, annually, etc.). All fees are in U.S. Dollars unless otherwise stated. You authorize us to charge your payment method on a recurring basis.

4.3 Payment Processing

Payments are processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method provided.

4.4 Price Changes

We reserve the right to change our subscription fees at any time. We will provide you with reasonable notice of any fee changes, and the changes will apply to your next billing cycle after the notice period.

5. Cancellation and Refunds

5.1 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at support@writeinfrench.com. Cancellation will take effect at the end of your current billing period, and you will retain access to the Service until that time.

5.2 No Refunds

All subscription fees are non-refundable. We do not provide refunds or credits for partial subscription periods. If you cancel your subscription, you will not receive a refund for the current billing period, but you may continue to use the Service until the end of that period.

5.3 Free Trial Cancellation

You may cancel your free trial at any time during the 7-day trial period without being charged. If you do not cancel before the trial ends, you will be charged for your first subscription period.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Share your account credentials with others
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers
• Copy, reproduce, distribute, or create derivative works from our content without permission
• Use automated systems (bots, scrapers) to access the Service
• Transmit any viruses, malware, or other harmful code
• Violate the intellectual property rights of others

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, images, audio, video, software, and course materials, are owned by us or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

8. User Content

You may have the opportunity to submit content through the Service (e.g., exercises, translations, feedback). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating and improving the Service.

9. Privacy and Data

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• Your language learning goals will be achieved

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless WriteInFrench.com, WriteInSpanish.com, and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado and the United States, without regard to conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Colorado, and you consent to personal jurisdiction in such courts.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
